GDPR – Application terms
1. Data controller:
BSCW, represented by its Board of Directors, which designates the Regional Treasurer (TR) as its representative.
2. Purpose of processing:
2.1 For members: to ensure that members are informed about the functioning of the association and in the areas covered by BSCW’s interventions, effective management of the allocation of members to missions, management of expenses and time incurred by members for their work within BSCW, including their possible invoicing to clients, collection of contributions, management of members’ insurance coverage (by communicating certain data to the insurance company).
2.2. For clients: to ensure the execution of the contract concluded, materialized by the DI.
3. Duration of retention of documents:
3.1 Documents relating to members: data is archived upon resignation, exclusion or death of the member.
3.2 Documents relating to clients: data is archived upon full completion of the mission and payment of services (in the event of bankruptcy, payment of services by the liquidator or notification by the liquidator that there is nothing to recover).
4. Transparency of information and communications (art. 12 of the GDPR):
BSCW undertakes to respond to any request for information made under the provisions of the GDPR and in compliance with the provisions of this regulation. Requests must be addressed to the representative (the TR).
5. Right of access and rectification, obligation to notify:
Members, having direct access to their data, can request rectification from the TR and verify the changes. Individual clients can send this request to their usual contact, who will forward it to the TR.
6. Right to erasure and withdrawal of consent:
It is not possible to delete records without compromising the integrity of the databases. Erasure will therefore consist of erasing all personal data and, if necessary, anonymizing the name. If a member requests to exercise this right, they will be deemed to have resigned (if they have not already), as this erasure makes it impossible to carry out normal member and mission management tasks. The same applies to the withdrawal of consent.
7. Relations with the supervisory authority and individuals, in particular in the event of a data breach (art 31, 33 and 34 of the GDPR):
in the event that one of the situations described in these articles arises, BSCW will take all necessary measures to comply with the obligations described.
8. Data recipients:
8.1 Member data: is intended only for members and the insurance company.
8.2 Customer data: is intended only for members, who are otherwise bound by professional secrecy.
9. Right of complaint:
to be exercised with the authority defined by law.
